Introducing Games and Drama on the Tune Talk App – Terms and Conditions
Effective Date: 21st May 2025

These Terms and Conditions (“Terms”) govern the use of the services known as “Introducing Games and Drama on the Tune Talk App” (collectively, the “Services”) provided by Tune Talk Sdn Bhd (“Tune Talk”, “we”, “us”, or “our”). By accessing or using any part of the Services through the Tune Talk Selfcare Application (“Tune Talk App”), you (“User”, “Subscriber”, or “you”) agree to be bound by the Terms set forth herein. If you do not agree with these Terms, you must not access or use the Services.

  1. ELIGIBILITY AND ACCESS RIGHT
    1. The Services are available exclusively to Tune Talk subscribers with an active account status of AC or G1, and subscribed to an eligible Tune Talk mobile tariff plan.
    2. Promotional Period Access:
      1. From 21st May 2025 onwards, for a duration of one (1) month (the “Promotional Period”), all Tune Talk subscribers, regardless of mobile plan, shall be granted complimentary full access to both Games and Drama on Tune Talk App.
    3. Post-Promotional Access Restrictions: Upon the expiry of the Promotional Period:
      1. Full Access to Drama shall be restricted to subscribers under the Epik50+.
      2. Limited Access to Drama shall be given to Epik35+ and Epik25+ plans only, with points redemption required to unlock episodes.
      3. Access to Games shall be restricted to subscribers under the Epik35+ or Epik50+ plans only.
    4. Impact on Redeemed Content during Promotional Period:
      Notwithstanding any point-based purchases made during the Promotional Period, subscribers who:
      1. Do not meet the eligibility criteria specified in Clause 1(c); and
      2. Have redeemed or unlocked content (e.g., drama episodes) using Tune Talk Points;

        shall no longer retain full access to such content unless they upgrade to an eligible plan thereafter (Epik50+ for Drama). No refunds, credits, or restitution shall be provided for any Tune Talk Points expended by ineligible users’ post-promotion.

    5. The Services are accessible solely via the Tune Talk App. No alternative access channels are permitted or supported.
  2. INTRODUCING DRAMA ON THE TUNA TALK APP
    1. Drama on the Tune Talk App is a proprietary digital streaming platform enabling users to exchange Tune Talk Points to watch, unlock, and engage with drama content in Points-Based Redemption Structure

      All Tune Talk Points redeemed are strictly non-refundable, non-exchangeable for cash, and non-transferable. Access to content is conditional upon continued subscription to the required eligible plan.

    2. Points Earning Mechanism – Viewing Activity
      1. Points shall be awarded in accordance with the following parameters:

      2. Points will only be issued for completed viewing sessions that meet the stated criteria.
      3. Tune Talk reserves the right to disqualify or void any activity deemed to be automated or fraudulent in nature.
  3. INTRODUCING GAMES ON THE TUNE TALK APP
    1. Games on the Tune Talk App is a gamified entertainment feature within the Tune Talk App allowing subscribers to earn Tune Talk Points through duration-based mobile gameplay.
    2. Points Earning Mechanism – Gameplay Duration

      Points shall only be credited for legitimate gameplay activity meeting the duration criteria stated above. Tune Talk may withhold or retract points in the event of suspicious or irregular usage patterns.

  4. PURCHASE OF TUNETALK POINTS
    1. Users may purchase Tune Talk Points through the Tune Talk App via supported payment methods:

      All point purchases are final and non-refundable. No reversals or reimbursements shall be entertained for unused, expired, or forfeited points.

  5. SUBSCRIBER OBLIGATIONS
    1. Users are solely responsible for maintaining the confidentiality of their account information and for all activities undertaken using their credentials.
    2. Users agree not to misuse the platform in any way, including but not limited to,
      1. Using bots, scripts, or emulator tools
      2. Trying to fake activity to earn more points;
      3. Bypassing security settings or restrictions;
      4. Sending malware or unauthorized content.
    3. Violation of this Clause may result in suspension, restriction, or permanent termination of access to the Services, and the forfeiture of any accumulated Tune Talk Points.
  6. LIMITATION OF LIABILITY
    1. The Services are provided on an “as-is” and “as-available” basis. Tune Talk disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
    2. Under no circumstances shall Tune Talk be held liable for any indirect, consequential, incidental, punitive, or special damages, including but not limited to data loss, service interruptions, or loss of points or content access.
  7. AMENDMENTS AND TERMINATION
    1. Tune Talk reserves the right to modify, suspend, or discontinue any portion of the Services or these Terms, at its sole discretion and without prior notice.
    2. Continued use of the Services following any such modification constitutes deemed acceptance of the amended Terms.
    3. In the event of service termination, all unused Tune Talk Points may be forfeited and shall not be eligible for reimbursement or compensation.
  8. GOVERNING AND JURISDICTION
    1. These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes or claims arising under or in connection with these Terms shall fall under the exclusive jurisdiction of the courts of Malaysia.
