Tune Talk Shop T&Cs

These Terms and Conditions (β€œTerms”) govern the access to and use of Tune Talk Shop (Powered by Presto) (β€œTune Talk Shop” or the β€œService”), a shopping feature made available through the Tune Talk Selfcare Application (β€œTune Talk App”) by Tune Talk Sdn Bhd (β€œTune Talk”, β€œwe”, β€œus”, or β€œour”).

By accessing or using Tune Talk Shop, you (β€œUser”, β€œSubscriber”, or β€œyou”) agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

  1. Definitions
    • For the purpose of these Terms:

      1. β€œTune Talk App” means the official Tune Talk Selfcare mobile application.
      2. β€œTune Talk Shop” means the shopping feature within the Tune Talk App powered by Presto, through which eligible users may browse, purchase products, and redeem Tune Talk Points for discounts, subject to these Terms.
      3. β€œPresto” means the third-party e-Commerce platform provider powering the Tune Talk Shop experience.
      4. β€œMSISDN” means the mobile number registered with Tune Talk.
      5. β€œTune Talk Points” means loyalty or reward points issued by Tune Talk under applicable Tune Talk loyalty or rewards programmes.
      6. β€œLinked Account” means a Presto account linked to a User’s MSISDN through the Tune Talk App upon successful authentication and consent.
      7. β€œTune Talk Subscriber” means a current Tune Talk customer with an active Tune Talk mobile service or account recognised by Tune Talk’s systems.
      8. β€œTune Talk Free App User” means a user who has access to the Tune Talk App without being an active Tune Talk mobile subscriber, subject to Tune Talk’s prevailing app access rules and system requirements.
  2. Eligibility
    1. Tune Talk Shop is available to:
      1. Current Tune Talk Susbcribers; and
      2. Tune Talk Free App Users who have access to the Tune Talk App

        *Subject to system availability and any additional eligibility requirements as maybe be determined by Tune Talk from time to time.

    2. Access to Tune Talk Shop may be tied to the User’s Tune Talk App account and/or registered MSISDN, where applicable.
    3. You must ensure that all information provided in connection with Tune Talk Shop is true, accurate, current, and complete.
  3. Nature of the Service
    1. Tune Talk Shop enables Users to access products and services made available through Presto within or through the Tune Talk App.
    2. Tune Talk Shop may allow users to:
      1. Link their Tune Talk account with Presto;
      2. View available Tune Talk Points balance;
      3. Redeem Tune Talk Points as a discount, subject to applicable rules;
      4. Make payment through supported payment methods;
      5. View transactions and purchase history; and
      6. Receive notifications, receipts, and order confirmations.
    3. Product listings, descriptions, pricing, stock availability, fulfilment, logistics, delivery, merchant terms, and order processing displayed within Tune Talk Shop may be provided by Presto and/or relevant merchants, and may be subject to change without prior notice.
  4. Account Linking and Consent
    1. To use Tune Talk Shop, you may be required to link your Tune Talk account with Presto.
    2. Where your account has not previously been linked, you will be presented with a consent screen requesting your permission to share certain information with Presto for the purpose of enabling the service.
    3. By proceeding with the account linking process, you expressly consent to tune Talk sharing the following information with Presto, as applicable:
      1. Mobile number / MSISDN, where applicable
      2. Email address; and
      3. User identification details required for the Service\
    4. If your account has previously been linked, you may be directed to the Presto web view or relevant tune Talk Shop interface without being shown the consent screen again, unless renewed consent is required.
    5. Account linking is personal to the User’s Tune Talk App account and/or MSISDN used for the link, where applicable. You are responsible for maintaining the confidentiality and security of your device, login credentials, and account access.
    6. Tune Talk may store, manage, refresh, suspend, revoke, or otherwise manage authentication tokens, access credentials, and related session data as necessary to operate the Service securely.
    7. Tune Talk reserves the right to suspend, revoke, or terminate your access to Tune Talk Shop where:
      1. consent is withdrawn;
      2. the linked account is found to be unauthorised, inaccurate, fraudulent, or compromised;
      3. required technical integration is unavailable; or
      4. such action is necessary for security, compliance, operational, or legal reasons.
  5. Tune Talk Points, Balance and Data Sharing
    1. Where applicable, Tune Talk Shop may display your available Tune Talk Points balance in near real-time, subject to system availability, processing delays, or synchronisation timing.
    2. Tune Talk may also display historical Tune Talk Points transactions, including deduction, reversal, refund, or status information, subject to data availability and processing timelines.
    3. Tune Talk Points may only be redeemed in accordance with the redemption rules determined by Tune Talk and/or Presto from time to time, including but not limited to:
      1. Minimum redemption thresholds;
      2. Maximum redeemable points for a specific product, order, SKU, campaign, or transaction;
      3. Rounding rules;
      4. Eligibility restrictions; and
      5. System validation requirements.
    4. For the avoidance of doubt;
      1. The minimum points redeemable shall be subject to the User’s available points balance and applicable redemption configuration;
      2. The maximum points redeemable may vary based on the relevant product, SKU, or promotion;
      3. The value of points applied as a discount shall be reflected at checkout where applicable; and
      4. Final redemption shall be subject to successful validation by Tune Talk’s and or Presto’s systems.
    5. Where the User’s available Tune Talk Points are insufficient for the intended redemption or discount, the user may be required to pay the remining amoung using an available payment method. Where points cannot be validly applied, the transaction may proceed at the original price or such other final payable amount as displayed at checkout.
    6. Tune Talk may securely share transaction outcome data, redemption status, and related operational data with Presto through system integrations, webhooks, callbacks, or other secure methods for the purpose of processing, validation, support, reconcilation, and record-keeping.
  6. Payment and Checkout
    1. Tune Talk Shop may support one or more payment methods, including but not limited to:
      1. Touch ’n Go eWallet;
      2. credit card;
      3. debit card;
      4. FPX;
      5. other eWallets; and/or
      6. any other payment methods made available from time to time.
    2. Availability of any payment method is subject to system capability, third-party provider availability, eligibility, and successful authorisation.
    3. Users may be allowed to combine Tuen talk Points and an available payment method in a single transaction, subject to checkout rules, payment gateway rules, and technical availability.
    4. All prices, savings, discounts, points deductions, and final payable amounts displayed at checkout are subject to final confirmation at the point of payment authorisation.
    5. Tune Talk does not guarantee uninterrupted availability of any payment flow, saved payment preference, or one-tap purchase feature.
    6. Where available, a one-tap or repeat purchase feature may use the User’s last successful payment preference or linked payment instrument. By using such feature, the User acknowledges and agrees that the relevant transaction shall be processed based on the displayed order details and selected payment setup.
    7. Tune Talk reserves the right to reject, suspend, cancel, or reverse any transaction that is suspected to be fraudulent, erroneous, unauthorised, abusive, non-compliant, or technically invalid.
  7. Orders, Fulfilment, and Transaction History
    1. Successful placement of an order does not guarantee fulfilment where there are subsequent issues relating to stock availability, merchant acceptance, logistics, fraud screening, technical failure, or other operational issues.
    2. Product fulfilment, shipping, delivery scheduling, logistics, and merchant-side order processing are handled by Presto and/or the relevant merchant and may be subject to their respective policies and timelines.
    3. Tune Talk may display order or transaction history within the Tune Talk App for reference purposes only. Such records may be delayed, incomplete, or subject to reconciliation.
    4. Users are responsible for reviewing all order details before confirming payment, including product, quantity, discount, points usage, delivery information, and payment amount.
  8. Refunds, Failed Payments, and Reversals
    1. In the event of a failed payment transaction where Tune Talk Points have been deducted, the deducted points shall be automatically refunded or reversed back to the User’s account, subject to system processing and reconciliation.
    2. Automatic refund or reversal of Tune Talk Points may not be instantaneous and may take reasonable time to reflect.
    3. Monetary refunds for successful payments, including but not limited to refund requests arising from cancellations, disputes, fulfilment issues, or other order-related matters, shall be handled manually through customer care in accordance with Tune Talk’s and/or the relevant merchant’s or Presto’s prevailing business-as-usual processes.
    4. Refund timelines, refund method, approval outcome, and supporting documentation requirements may vary depending on the nature of the case, payment method used, and internal verification requirements.
    5. Tune Talk reserves the right to investigate any refund, reversal, or dispute request before approving any action.
  9. Notifications and Communications
    1. Tune Talk may send push notifications though the Tune Talk App in relation to successful payments, failed payments, transaction status, or other relevant events.
    2. Tune Talk may issue and invoice, payment receipt, or transaction confirmation through email or other available channels, which may include the Presto transaction ID and relevant order information.
    3. For the avoidance of doubt, a User may receive multiple communications relating to the same transaction, including but not limited to:
      1. a payment-related receipt from the payment gateway;
      2. a receipt, invoice, or confirmation from Tune Talk; and/or
      3. an order confirmation, delivery update, or logistics notification from Presto or the relevant merchant.
    4. Order confirmation, delivery updates, and logistics notifications shall be sent to the User by Presto and/or the relevant merchant to the email address provided or registered for the transaction.
    5. It is the User’s responsibility to ensure that their registered email address and contact details are accurate and up to date.
  10. Points Redemption Rules and Restrictions
    1. Tune Talk Points are not cash, are not transferable, are not exchangeable for cash, and may only be used in accordance with applicable Tune Talk rules and these Terms.
    2. Tune Talk reserves the right to set, amend, suspend, or remove any rule relating to points redemption, including conversion value, minimum or maximum redemption thresholds, eligible products, excluded categories, campaign-specific conditions, and expiry treatment.
    3. Any misuse, abuse, manipulation, fraudulent activity, or unauthorised accumulation or redemption of Tune Talk Points may result in:
      1. Cancellation of the transaction;
      2. Forfeiture of points;
      3. Suspension or termination of access to Tune Talk Shop or related services; and/or
      4. Any other action Tune Talk deems appropriate.
  11. Third-Party Platform and Merchant Disclaimer
    1. Tune talk Shop is powered by Presto and may involve third-party merchants, payment providers, delivery providers, and related service providers.
    2. Tune Talk does not manufacture, store, own, or directly fulfil the products listed by merchants unless expressly stated otherwise.
    3. To the fullest extent permitted by law, Tune Talk shall not be responsible for:
      1. product quality, merchantability, fitness, safety, legality, or accuracy of product descriptions;
      2. merchant conduct or service quality;
      3. stock availability;
      4. delivery delays, failed delivery, or logistics issues;
      5. third-party platform downtime or errors; or
      6. acts or omissions of Presto, merchants, payment providers, or logistics partners.
    4. Any dispute relating to product quality, fulfilment, merchant representations, or delivery may be subject to the policies and processes of Presto and/or the relevant merchant, in addition to Tune Talk’s support processes where applicable.
  12. Availability and Changes to the Service
    1. Tune Talk Shop is provided on an β€œas is” and β€œas available” basis.
    2. Tune Talk may at any time and without prior notice:
      1. modify, suspend, restrict, or discontinue all or any part of Tune Talk Shop;
      2. add or remove features, products, payment methods, redemption mechanics, or integrations;
      3. revise the interface, checkout process, or redemption flow; or
      4. impose limits or operational conditions on the use of the Service.
    3. Tune Talk does not guarantee that Tune Talk Shop will always be available, error-free, secure, or free from interruption.
  13. User Responsibilities
    1. You agree to use Tune Talk Shop lawfully and in accordance with these Terms.
    2. You must not:
      1. misuse the Service;
      2. attempt to gain unauthorised access to any system, account, token, or integration;
      3. submit false, misleading, or fraudulent information;
      4. manipulate points, transactions, redemptions, refunds, or pricing;
      5. interfere with the integrity or performance of the Service; or
      6. use Tune Talk Shop for unlawful, abusive, or prohibited purposes.
  14. Personal Data and Privacy
    1. By using Tune Talk Shop and completing the account linking flow, you acknowledge and agree that your personal data may be collected, used, processed, disclosed, and shared between Tune Talk and Presto for the purposes of:
      1. account linking;
      2. identity verification;
      3. transaction processing;
      4. points validation and redemption;
      5. order management;
      6. support and dispute handling;
      7. receipt and notification delivery;
      8. fraud prevention, security, audit, and compliance; and
      9. operation and improvement of the Service.
    2. Such processing and sharing of personal data shall be subject to Tune Talk’s applicable privacy practices and any applicable legal or regulatory requirements.
  15. Limitation of Liability
    1. To the fullest extent permitted by law, Tune Talk shall not be liable for any loss, damage, cost, or expense arising from or in connection with:
      1. the use of or inability to use Tune Talk Shop;
      2. failed, delayed, rejected, duplicated, or reversed transactions;
      3. inaccurate balances, delayed sync, or display errors;
      4. merchant, logistics, or third-party payment issues;
      5. system downtime, maintenance, interruption, or technical errors; or
      6. unauthorised access caused by the User’s own act, omission, negligence, or device compromise.
    2. Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
  16. Suspension and Termination
    1. Tune Talk may suspend, restrict, or terminate your access to Tune Talk Shop at any time, with or without notice, if:
      1. you breach these Terms;
      2. your Tune Talk account, Tune Talk App account, MSISDN, or linked Presto access is inactive, terminated, suspended, or restricted;
      3. fraud, abuse, security risk, or suspicious activity is detected;
      4. required third-party services are unavailable; or
      5. Tune Talk is required to do so for legal, regulatory, technical, or operational reasons.
  17. Amendments
    1. Tune Talk reserves the right to amend, update, vary, or revise these Terms at any time without prior notice.
    2. The latest version of these Terms shall prevail and will be made available through the Tune Talk App, Tune Talk website, or other official communication channels.
    3. Continued use of Tune Talk Shop after any amendment constitutes your acceptance of the revised Terms.
  18. Governing Law
    1. These Terms shall be governed by and construed in accordance with the laws of Malaysia.
    2. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Malaysia.
  19. Support
