Link, Scratch & Win Campaign T&Cs
- GENERAL
- These Terms and Conditions govern participation in the Campaign and are supplementary to, and must be read together with, Tune Talk’s prevailing Service Subscription Terms and Conditions and Privacy Policy.
- By participating in the Campaign, the Subscriber agrees to be bound by these Terms and Conditions and any decisions made by Tune Talk in relation to the Campaign.
- In these Terms and Conditions (“Terms and Conditions”), unless the context otherwise requires:
- “Campaign” means the “Link, Scratch & Win” campaign described in these Terms and Conditions;
- “Tune Talk” means Tune Talk Sdn. Bhd.;
- “Subscriber” means an eligible active Tune Talk subscriber who participates in the Campaign in accordance with these Terms and Conditions;
- “Tune Talk App” means the Tune Talk mobile application through which the Campaign is administered (confirm — see Clarification 1);
- “eWallet” means a Touch ‘n Go eWallet account facilitated by TNG Digital Sdn. Bhd.; and
- “Reward” means the voucher or other reward made available under the Campaign, as described in Clause 5 (Rewards) below.
- CAMPAIGN PERIOD
- The Campaign is ongoing and has no fixed start or end date. The Campaign shall continue until the reward pool is fully exhausted or varied, suspended, extended or terminated by Tune Talk at its discretion in accordance with Clause 12 (Changes, Suspension and Termination) below (the “Campaign Period”).
- ELIGIBILITY
- The Campaign is open exclusively to eligible active Tune Talk subscribers who link their eWallet account for the first time. Subscribers who have previously linked and subsequently unlinked or removed an eWallet account from their Tune Talk account shall not be eligible.
- Participation and entitlement under the Campaign is limited to once (1) per Subscriber, determined by reference to the NRIC (or other identification document number) registered against the Subscriber’s Tune Talk account, regardless of the number of Tune Talk lines held by that Subscriber (confirm — see Clarification 2).
- To qualify for the Campaign, the Subscriber must successfully link an eWallet account to their Tune Talk account via the Tune Talk App during the Campaign Period.
- Subscribers remain responsible for meeting the eWallet’s own eligibility and verification requirements (including any applicable age or identification requirements) for the purposes of linking their account.
- Eligibility shall be determined based on Tune Talk’s records, and Tune Talk’s decision on eligibility shall be final and binding.
- CAMPAIGN MECHANICS
- To participate in the Campaign, an eligible Subscriber must complete the following steps:
- successfully link their eWallet account via the Tune Talk App;
- upon successful linking, a scratch card will be triggered and displayed within the Tune Talk App; and
- answer one (1) skill-based question correctly, as presented in the Tune Talk App.
- Each eligible Subscriber may participate in the Campaign once (1) only, as determined under Clause 3 (Eligibility) above.
- Each Subscriber is given one (1) attempt to answer the skill-based question. A Subscriber who answers incorrectly will not be eligible to receive a Reward and will not be entitled to any further attempt.
- A Subscriber who successfully completes the steps above and answers the skill-based question correctly will receive one (1) Reward.
- To participate in the Campaign, an eligible Subscriber must complete the following steps:
- REWARDS
- Rewards will be allocated to eligible Subscribers on a random basis, and the type and value of the Reward received may vary.
- Reward values available under the Campaign range up to RM10,000 (confirm — see Clarification 3).
- Tune Talk reserves the right to add, expand, replace, substitute, vary or modify the Rewards available under the Campaign at its sole discretion, including by introducing new Reward variations from time to time, so as to ensure continued Reward availability to Subscribers throughout the Campaign Period.
- Rewards are non-transferable, non-refundable and cannot be exchanged for cash, credit or any other form of compensation, unless otherwise stated.
- Rewards may be subject to additional terms and conditions imposed by the respective reward provider, including validity periods and redemption requirements.
- Tune Talk shall not be responsible for any unused, expired, lost, deleted or unredeemed Reward after the Reward has been issued to the Subscriber.
- All rewards are distributed on a first come first serve bases and are strictly subject to stock and reward pool availability. Tune Talk makes no representation that every participant will receive a reward of maximum value.
- REWARD NOTIFICATION AND REDEMPTION
- Upon successfully answering the skill-based question correctly, the Reward allocated to the Subscriber will be displayed immediately in the Tune Talk App.
- Details of the Reward, including applicable redemption instructions, terms and conditions and the validity period, will be displayed or made available to the Subscriber through the Tune Talk App.
- The Subscriber is responsible for reviewing and complying with the applicable terms and conditions, redemption instructions and validity period of the Reward received.
- Tune Talk shall not be responsible for any failure by a Subscriber to redeem or utilise the Reward within the applicable validity period.
- NON-RETRIEVAL OF REWARD
- The Reward will be displayed within the Tune Talk App on a one-time basis only.
- It is the sole responsibility of the Subscriber to record, copy, save or redeem the Reward immediately upon display.
- Tune Talk shall not be responsible for any Reward that is lost, expired, incorrectly copied, dismissed, deleted or otherwise unredeemed. No replacement, reissuance or compensation will be provided (confirm — see Clarification 4).
- VERIFICATION, FRAUD AND ABUSE
- Tune Talk reserves the right to verify all linking records, eligibility and participation records (including the NRIC/identification document number used) before awarding any Reward.
- A Subscriber found to have breached these Terms and Conditions, manipulated the Campaign mechanics, attempted fraudulent participation (including through duplicate registration across multiple lines or automated means) or provided inaccurate information may be disqualified without prior notice, and any Reward awarded may be revoked.
- THIRD-PARTY PRODUCTS OR SERVICES
- The linking and use of the eWallet is subject to the separate terms and conditions, privacy policy and eligibility requirements of TNG Digital Sdn. Bhd., which are outside Tune Talk’s control.
- Tune Talk makes no representation or warranty regarding the availability, acceptance, usability, functionality, quality or performance of any Reward or third-party service associated with the Reward.
- Tune Talk shall not be responsible for any rejection, suspension, expiration or limitation relating to the redemption or use of a Reward by the relevant third-party provider.
- LIMITATION OF LIABILITY
- To the extent permitted by applicable law, Tune Talk shall not be liable for any interruption, delay, failure, omission, system malfunction, application issue, device issue, internet connectivity issue, payment processing issue or other technical problem affecting participation in the Campaign or redemption of a Reward, save to the extent such liability cannot be excluded under applicable law or arises from Tune Talk’s gross negligence or wilful misconduct.
- Tune Talk shall not be liable for any inability of a Subscriber to participate due to account restrictions, device incompatibility, application version issues, or other circumstances beyond Tune Talk’s reasonable control.
- PERSONAL DATA AND PRIVACY
- The collection, processing, use and disclosure of a Subscriber’s personal data in connection with the Campaign is subject to the Personal Data Protection Act 2010 and Tune Talk’s prevailing Privacy Policy.
- Linking an eWallet account may involve the sharing of information with TNG Digital Sdn. Bhd., which is subject to TNG Digital’s own privacy terms. Subscribers are encouraged to review TNG Digital’s privacy policy before linking their account.
- CHANGES, SUSPENSION AND TERMINATION
- Tune Talk reserves the right to amend, modify, vary, suspend, extend, terminate or cancel the Campaign and/or these Terms and Conditions at any time. Where a material change affects Subscribers, Tune Talk will, where reasonably practicable, provide notice through appropriate channels.
- GENERAL TERMS
- Participation in the Campaign constitutes the Subscriber’s full and unconditional agreement to these Terms and Conditions and any decision made by Tune Talk in relation to the Campaign.
- All decisions made by Tune Talk relating to the Campaign, including eligibility, qualification, participation records, Reward entitlement and Reward distribution, shall be final, binding and conclusive.
- In the event of any inconsistency between any promotional material and these Terms and Conditions, these Terms and Conditions shall prevail.
- Where these Terms and Conditions are translated into a language other than English, the English-language version shall prevail in the event of any inconsistency.
- GOVERNING LAW
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, and Subscribers agree to submit to the non-exclusive jurisdiction of the Malaysian courts.
