sooka X Tune Talk - Free 1-Month sooka Pass T&Cs
- GENERAL
- These Terms and Conditions (“Campaign Terms“) govern participation in the sooka x Tune Talk Free 1-Month sooka Pass campaign (“Campaign“) and are supplementary to, and must be read together with, Tune Talk’s prevailing Service Subscription Terms and Conditions and Privacy Policy.
- By purchasing and activating an Eligible Plan during the Campaign Period and/or participating in the Campaign, the Subscriber agrees to be bound by these Campaign Terms and any decisions made by Tune Talk in relation to the Campaign.
- In these Campaign Terms, unless the context otherwise requires:
- “Campaign” means the sooka x Tune Talk Free 1-Month sooka Pass campaign described in these Campaign Terms;
- “Tune Talk” means Tune Talk Sdn. Bhd.;
- “sooka” means sooka [full legal entity name to be confirmed — see Clarification 2], Tune Talk’s partner for the provision of the sooka Pass under the Campaign;
- “Subscriber” means a new Tune Talk user who purchases and successfully activates an Eligible Plan during the Campaign Period, as further described in Clause 3 (Eligibility) below;
- “Eligible Plan” means the Epik+ 35 plan or the Epik+ 50 plan;
- “Tune Talk App” means the Tune Talk mobile application through which the Campaign is administered;
- “sooka Pass” means the free 1-month sooka Pass made available to eligible Subscribers under the Campaign, as described in Clause 5 (Reward) below; and
- “Voucher” means the voucher code issued to an eligible Subscriber for redemption of the sooka Pass.
- CAMPAIGN PERIOD
- The Campaign is valid from 28 September to 30 November [year to be confirmed — see Clarification 1] (both dates inclusive) (the “Campaign Period”).
- Tune Talk reserves the right to extend, shorten or otherwise vary the Campaign Period in accordance with Clause 12 (Changes, Suspension and Termination) below.
- ELIGIBILITY
- The Campaign is open to new Tune Talk users who:
- purchase an Eligible Plan; and
- successfully activate the Eligible Plan,
during the Campaign Period (confirm scope of “new Tune Talk user” — see Clarification 3).
- Entitlement under the Campaign is limited to one (1) sooka Pass per mobile number, and to one (1) sooka Pass per Subscriber as determined by the NRIC (or other identification document number) registered against the Subscriber’s Tune Talk account, regardless of the number of new Tune Talk lines activated by that Subscriber during the Campaign Period (confirm treatment for Subscribers without an NRIC — see Clarification 4).
- Eligibility shall be determined based on Tune Talk’s records, and Tune Talk’s decision on eligibility shall be final and binding.
- The Campaign is open to new Tune Talk users who:
- CAMPAIGN MECHANICS
- To participate in the Campaign, an eligible Subscriber must complete the following steps:
- purchase and successfully activate an Eligible Plan during the Campaign Period;
- within 48 hours of successful activation, receive a push notification and SMS directing the Subscriber to the Tune Talk App;
- access the Voucher through the banner displayed on the Tune Talk App homepage; and
- redeem the sooka Pass using the Voucher code provided in the Tune Talk App.
- Each eligible Subscriber may redeem the offer once (1) only, as set out in Clause 3(b) above.
- To participate in the Campaign, an eligible Subscriber must complete the following steps:
- REWARD
- An eligible Subscriber will receive one (1) free 1-month sooka Pass, worth RM31.99.
- The sooka Pass provides the Subscriber with one (1) month of access to sooka.
- The stated value of the sooka Pass reflects sooka’s prevailing retail price as at the time of this Campaign and may be subject to change by Sooka.
- VOUCHER NOTIFICATION AND REDEMPTION
- The Voucher will be made available to the eligible Subscriber within 48 hours of successful activation of the Eligible Plan.
- Notice of Voucher availability will be sent to the Subscriber by way of a push notification and SMS directing the Subscriber to the Tune Talk App.
- The Voucher may also be accessed by the Subscriber through the banner on the Tune Talk App homepage, whether or not the push notification or SMS is received.
- The Subscriber is responsible for redeeming the sooka Pass using the Voucher code provided in the Tune Talk App within the validity period set out in Clause 7 (Voucher Validity) below.
- VOUCHER VALIDITY
- The Voucher is valid for 30 days from the date of redemption.
- The validity period of the Voucher is separate from, and not dependent on, the validity of the Eligible Plan purchased by the Subscriber.
- Tune Talk shall not be responsible for any Voucher that is not redeemed within the applicable validity period. No replacement, extension or compensation will be provided (confirm — see Clarification 8).
- VERIFICATION, FRAUD AND ABUSE
- Tune Talk reserves the right to verify eligibility, activation records (including the NRIC or other identification document number used) and participation records before issuing any Voucher.
- A Subscriber found to have breached these Campaign Terms, manipulated the Campaign mechanics, attempted fraudulent participation (including through multiple registrations or activations across different mobile numbers designed to circumvent the redemption limit in Clause 3(b)) or provided inaccurate information may be disqualified without prior notice, and any sooka Pass or Voucher issued may be revoked.
- THIRD-PARTY PRODUCTS OR SERVICES
- The sooka Pass is provided by sooka, and use of the sooka Pass and the sooka platform is subject to sooka’s own terms and conditions and privacy policy, which are outside Tune Talk’s control.
- Tune Talk does not control, and makes no representation or warranty regarding, the availability, content, functionality or performance of sooka’s platform or services.
- Tune Talk shall not be liable for any matter relating to the sooka Pass or the sooka platform solely attributable to sooka, including redemption issues, content availability or service interruptions, except where required by applicable law.
- LIMITATION OF LIABILITY
- To the extent permitted by applicable law, Tune Talk shall not be liable for any interruption, delay, failure, omission, system malfunction, application issue, device issue, internet connectivity issue or other technical problem affecting participation in the Campaign, issuance of the Voucher or redemption of the sooka Pass, save to the extent such liability cannot be excluded under applicable law or arises from Tune Talk’s gross negligence or wilful misconduct.
- Tune Talk shall not be liable for any failure by a Subscriber to receive a push notification or SMS due to device settings, network conditions or other circumstances outside Tune Talk’s reasonable control, provided that the Voucher remains accessible through the Tune Talk App homepage banner in accordance with Clause 6(c).
- PERSONAL DATA AND PRIVACY
- The collection, processing, use and disclosure of a Subscriber’s personal data in connection with the Campaign is subject to the Personal Data Protection Act 2010 and Tune Talk’s prevailing Privacy Policy.
- Redemption of the sooka Pass may involve the sharing of information with sooka, which is subject to sooka’s own privacy terms. Subscribers are encouraged to review sooka’s privacy policy before redeeming the Voucher.
- CHANGES, SUSPENSION AND TERMINATION
- Tune Talk reserves the right to amend, modify, vary, suspend, extend, terminate or cancel the Campaign and/or these Campaign Terms at any time. Where a material change affects Subscribers, Tune Talk will, where reasonably practicable, provide notice through appropriate channels.
- GENERAL TERMS
- Participation in the Campaign constitutes the Subscriber’s full and unconditional agreement to these Campaign Terms and any decision made by Tune Talk in relation to the Campaign.
- All decisions made by Tune Talk relating to the Campaign, including eligibility, participation records and Voucher issuance, shall be final, binding and conclusive.
- In the event of any inconsistency between any promotional material and these Campaign Terms, these Campaign Terms shall prevail.
- Where these Campaign Terms are translated into a language other than English, the English-language version shall prevail in the event of any inconsistency.
- GOVERNING LAW
- These Campaign Terms shall be governed by and construed in accordance with the laws of Malaysia, and Subscribers agree to submit to the non-exclusive jurisdiction of the Malaysian courts.
