Tune Talk VAS Airtime and Data Subscription (International) T&Cs
These Terms and Conditions (“Terms”) apply to your use of the VAS Airtime (International) and VAS Data Subscription (International) services (each a “Service” and collectively the “Services”) offered under Tune Talk’s Value Added Services (“VAS”). These Terms are to be read together with the Tune Talk VAS (Value Added Services) Terms & Conditions (“VAS Terms”), which apply to all VAS services. In the event of any conflict between these Terms and the VAS Terms, these Terms shall prevail in respect of the Services.
- Definitions
- “Aggregator” means the third-party service provider appointed by Tune Talk to process and fulfil purchases of Products with the Recipient Operator.
- “Airtime Top-Up” means the prepaid airtime purchased through VAS Airtime (International) for a Recipient Number.
- “Data Plan” means the mobile data subscription plan purchased through VAS Data Subscription (International) for a Recipient Number.
- “Product” means an Airtime Top-Up or a Data Plan, as applicable.
- “Recipient Number” means the international mobile number designated by you to receive the Product, and “Recipient” means the user of that number.
- “Recipient Operator” means the mobile operator of the Recipient Number.
- “Services” means:
- VAS Airtime (International), which enables you to send prepaid Airtime Top-Ups to selected international mobile numbers; and
- VAS Data Subscription (International), which enables you to purchase Data Plans for selected international mobile numbers.
- “TTNow+” refers to the Tune Talk airtime balance, which may be used as a payment method for VAS transactions.
- “Tune Talk” means Tune Talk Sdn. Bhd.
- “User” or “you” means any person who accesses or uses VAS and the Services.
- “VAS” means the Tune Talk platform offering Value Added Services, including International Airtime, International Utilities, International Vouchers, International Data Subscription and Google Direct Carrier Billing (Google DCB).
- Service Description
- General
- The Services enable you to purchase Products for Recipient Numbers registered with participating Recipient Operators in selected countries.
- The supported countries, Recipient Operators, denominations, Data Plans, prices and payment methods will be displayed in the [Tune Talk app] at the time of purchase and may be updated by Tune Talk from time to time.
- Tune Talk facilitates the purchase of Products through the Aggregator. Tune Talk does not own or operate the Recipient Operator’s network and does not control its coverage, speed or service availability.
- VAS Airtime (International)
- The Airtime Top-Up will be credited to the prepaid balance of the Recipient Number. The denomination and, where available, the airtime value to be received by the Recipient will be displayed before you confirm your purchase.
- Once credited, the use and validity of the Airtime Top-Up are governed by the Recipient Operator’s terms.
- VAS Data Subscription (International)
- The data quota, validity and usage conditions of each Data Plan are determined by the Recipient Operator and will be displayed at the time of purchase.
- Once activated, the use of the Data Plan is governed by the Recipient Operator’s terms.
- General
- Payment Methods and Charges
- All payments for the Services are subject to the payment methods, charges and service tax provisions stated in the VAS Terms.
- The price of each Product will be displayed in Ringgit Malaysia (RM) before you confirm your purchase.
- A Product will only be processed after your payment has been successfully completed.
- Eligibility
- The Services are available to all active Tune Talk subscribers.
- When making a purchase, you must:
- provide the correct and complete Recipient Number, including the country code;
- select the correct country, Recipient Operator and Product for the Recipient Number; and
- ensure that you are authorised to provide the Recipient Number for this purpose.
- The Recipient Number must be eligible to receive the selected Product under the Recipient Operator’s rules. The Recipient Operator may reject a Product where the Recipient Number is ineligible.
- Delivery and Activation
- Upon successful payment, the Product will be submitted to the Recipient Operator to be credited (for an Airtime Top-Up) or activated (for a Data Plan) on the Recipient Number. A Product is “fulfilled” once it has been successfully credited or activated.
- Fulfilment time may vary depending on the Recipient Operator, network conditions and system availability.
- You will be notified of the transaction status via in-app notification.
- Any notification to the Recipient regarding the Product is at the discretion of the Recipient Operator.
- Refunds and Cancellations
- Once a Product has been fulfilled, the transaction is final and cannot be cancelled, refunded, exchanged, or converted into cash or Tune Talk credit.
- No refund will be given where the Product has been fulfilled on the Recipient Number provided by you, including where the Recipient Number was entered incorrectly.
- Where payment has been deducted but the Product is not fulfilled:
- Payment via TTNow+
- The deducted amount will be refunded to your original payment method after verification by Tune Talk within 14 working days.
- Payment via other payment methods
- You may contact the Tune Talk Customer Careline as stated in Clause 13 for assistance.
- All such requests will be reviewed and processed in accordance with Tune Talk’s refund policies.
- Payment via TTNow+
- Limitations
- Tune Talk shall not be responsible for:
- any incorrect Recipient Number provided by you;
- refusal or rejection of the Product by the Recipient Operator;
- delays by the Recipient Operator in processing, crediting or activating the Product;
- the Recipient Operator’s network coverage, speed or availability, or the compatibility of the Recipient’s device; and
- the Recipient’s use of the Product after fulfilment.
- Where a Product is rejected or not fulfilled under Clause 7(a), any refund shall be handled in accordance with Clause 6(c).
- Tune Talk shall not be responsible for:
- Privacy and Data Protection
- Your personal information will be processed in accordance with the Personal Data Protection Act 2010 and Tune Talk’s Privacy Policy.
- By using the Services, you acknowledge that the Recipient Number and relevant transaction details will be shared with the Aggregator and the Recipient Operator solely for the purpose of processing and fulfilling your purchase.
- Fraud, Suspension and Termination
- Tune Talk may reject, cancel or reverse any transaction, and/or suspend or terminate your access to the Services, where Tune Talk reasonably suspects:
- fraudulent or unauthorised use of the Services or any payment method;
- exploitation of any technical, system or pricing error;
- unauthorised resale of the Services; or
- any breach of these Terms or the VAS Terms.
- Tune Talk may suspend, modify or discontinue the Services, in whole or in part, for operational, technical, regulatory or security reasons. Where reasonably practicable, Tune Talk will provide notice through appropriate channels.
- Tune Talk may reject, cancel or reverse any transaction, and/or suspend or terminate your access to the Services, where Tune Talk reasonably suspects:
- Limitation of Liability
- Tune Talk will use reasonable efforts to provide the Services but does not guarantee that the Services will be uninterrupted or error-free. The Services may be affected by maintenance, system upgrades, network interruptions or third-party system failures.
- Tune Talk will use reasonable efforts to rectify issues within its control, including processing refunds in accordance with Clause 6(c).
- To the extent permitted by applicable law, Tune Talk shall not be liable for:
- any indirect, incidental or consequential loss;
- any loss attributable solely to the Aggregator, the Recipient Operator or any other third party; or
- any loss arising from your failure to comply with these Terms, including the provision of inaccurate information.
- To the extent permitted by applicable law, Tune Talk’s total liability in respect of any transaction shall not exceed the amount paid by you for that transaction.
- Nothing in these Terms excludes or limits any rights you may have under applicable law that cannot be excluded or limited.
- Amendments
- Tune Talk may amend these Terms from time to time. The amended Terms will be published on Tune Talk’s website. Where an amendment materially affects you, Tune Talk will provide notice through appropriate channels where reasonably practicable.
- Your continued use of the Services after the amended Terms take effect constitutes your acceptance of them. Amendments shall not apply to transactions completed before the effective date of the amendment.
- Governing Law
- These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
